These terms apply to the Fliptrick iPhone app and to this website, both made by LatentEdge. If you use the app or the website, you agree to these terms. If you do not agree, do not use them.

License to use the app

We give you a personal, non-transferable license to use Fliptrick on Apple devices that you own or control, as the App Store rules allow. Apple's Licensed Application End User License Agreement also applies to your use of the app. You may not copy, resell, or reverse engineer the app, except where the law gives you that right.

Keep the phone in your hands

Motion mode asks you to turn your iPhone with your fingers. The phone must stay in your hands. Never throw your phone. The app detects free fall and does not score a trick when the phone is in the air. You are responsible for how you handle your device. We are not responsible for a dropped, damaged, or lost device, or for an injury or for damage to property, that results from how you use motion mode.

Use motion mode only where you have room, and stop if your grip is not secure.

Skateboarding

Fliptrick is a toy. It does not teach you to skateboard. Real skateboarding carries a risk of injury, and nothing in the app is safety advice.

No warranty

The app and the website are provided "as is" and "as available", without a warranty of any kind, to the extent that the law allows. We do not promise that the app will name every trick correctly or that it will work without interruption.

Limitation of liability

To the extent that the law allows, LatentEdge is not liable for any indirect, incidental, special, or consequential damages, or for damage to a device, that arise from your use of the app or the website. Some places do not allow some of these limits, so some of them may not apply to you.

Governing law

The laws of the State of Indiana, United States, govern these terms, without regard to its conflict-of-law principles. The state and federal courts located in Indiana have exclusive jurisdiction over a dispute about these terms, unless the law where you live gives you a right that these terms cannot take away.

Changes

We may change these terms. The revised terms take effect on the date they are posted here, and we will change the date at the top of this page. If you keep using the app after a change, you accept the revised terms.
